The first charge is in respect of the Cordeiro
estate. It is admitted by Alim Khan that certain money was paid to him, in respect of the fees in this matter, by a Mr. Iloronha, and that he retained part of the money after the issue of Letters of Administration. It is admitted by the Registrar that Letters of Administration should not have been issued before the total fees were accounted for, but that in fact they had been issued by an oversight before the proper fees were received; and Alim Khan explained his retention of the money as an oversight. Mr. Noronha gave evidence to the effect that in or about the month of Larch, 1913, he paid to Alim Khan, at Alim Khan's request, a sum of a ome 870 in respect of fees, receiving no receipt; that he frequently applied to Alim khan for the issue of Letters of Administration and that he was on each occasion put off by one excuss or another; that towards the end of June Letters of Administration were issued; that in July Alim Khan called at his office, informed him that the Government were examining his (Alim Khan's) books and papers, and asked him, if the Registrar should enquire, to say that he had paid no fees and to pay them de novo, in which event Ali Khan would pay the money back. Alim Khan at the same time stated that if anything were discovered against him he might be dismissed. It may be mentioned that Mr. Horonha has been for tome jeure past in charge of the Government printing, that he has been entrusted with various confidential matters, and that he has always been found capable, trustworthy, and conscientious. I see no reason to doubt any part of his evidence.

The second charge is conce ned with the retention of money in connection with five separate estates. The retention is admitted. It is pleaded that the Registrar was well aware that Alim Khan was in the habit of receiving fees in advance, and that, as the estates were not wound up when Alim khan left the Registry at the end of June, the money was not at that date owing to the Government.
